Currently, there are no laws that have been made to dictate who can work as an auctioneer. Therefore, any individual who has good communication skills and experience in the field can work as an auctioneer. It is however mandatory to get licensed in order to act as an auctioneer. The licenses are meant to limit the area of operation of the person. It is against the law for one to operate outside their area of operation as indicated on the license.

Licensing officers reserve the power to deny applicants a license if they deem it necessary. This must be done impartially, reasonably, and with the intention of promoting communal interests. Licenses that are already issued can also be revoked if there is evidence of wrongdoing. If one has their license revoked, they are required to stop acting as auctioneers immediately.

Auctioneers usually work for sellers who employ them. Therefore, they must put the interests of the seller at the forefront in all dealings. In order for the statute of frauds to be satisfied, a written agreement is always required. The auctioneer is given the power to sign a memorandum of sale in place of purchasers or sellers.

Once the goods have been sold via an announcement that the sale is concluded, the authority that the auctioneer has is terminated immediately. However, prior to the sale, the seller usually has the authority to take away this authority any time they see fit. Hence, so long as the auctioneer holds the power to act in the place of the seller, they can do anything to make the sale happen.
